Labor Initiatives supported two workers of a municipal preschool institution who had been illegally dismissed due to staff reductions.<\/p>\n\n\n\n
The women were unaware of the staff reduction directive and had no alternative positions offered to them. With help from Labor Initiatives, they submitted claims to contest the dismissal orders, seek reinstatement, and recover lost wages.<\/p>\n\n\n\n
The court dismissed the employer\u2019s assertion that no alternative positions were available because the workers reached retirement age. It clarified that in a reorganization, all rights and obligations \u2014 including job responsibilities \u2014 are transferred to the legal successor, rather than solely the property rights.<\/p>\n\n\n\n
