Successful Reinstatement At the Workplace with Compensation Payment

Lawyers from Labor Initiatives successfully defended the rights of a national park employee who was illegally dismissed while working remotely.

The worker, an internally displaced person, had agreed with the management to perform his duties remotely after relocating from an occupied territory. Despite this arrangement, he was later dismissed for alleged absenteeism without a valid reason. Labor Initiatives’ legal team prepared a lawsuit highlighting procedural violations during the dismissal. The court ruled that the dismissal was unlawful, ordered the worker’s reinstatement, and awarded him compensation for the forced absence in the amount of approximately UAH 60,000.

Following the first-instance court victory, the employer filed an appeal. In response, Labor Initiatives’ lawyers prepared the necessary procedural documents, requesting the court to uphold the initial ruling. The appellate court confirmed the worker’s reinstatement and upheld his right to compensation.

This case once again highlights the importance of strictly following legal procedures when suspending or terminating employment and the inadmissibility of dismissals without proper justification.
