Court Upholds Worker’s Rights in Dismissal Case Against Private Employer

Labor Initiatives’ legal team has once again successfully defended the rights and interests of a private sector worker — this time in an appellate court.

On May 5, 2020, the employee submitted a resignation letter citing health issues, but the employer ignored it. As a result, the worker had to file a lawsuit to terminate the employment relationship. After going through all three judicial instances, the worker’s claim was fully satisfied.

During the court proceedings, it was revealed that the employer terminated the employee in July 2020 due to absenteeism, rather than voluntary resignation. Consequently, the employee filed a second lawsuit in October 2020 to contest the dismissal and the disciplinary actions taken action.

Labor Initiatives’ lawyers assisted in drafting procedural documents and providing legal consultations. They also emphasized that the employer failed to comply with previous court decisions and that facts established by a legally binding court ruling are not subject to re-examination in related proceedings involving the same matter parties.

In early June 2022, the appellate court upheld the lower court’s decision, declaring the dismissal order illegal and canceling it.
