Court Confirms Validity of IDP Pensioner’s Diploma Despite Name Error

Lawyers from Labor Initiatives successfully defended the rights of an internally displaced pension-age person in court.

The individual approached the organisation after facing difficulties during a pension recalculation process. It was discovered that their education diploma, issued in the 1980s, contained a surname spelling error in Russian transliteration that did not match the passport data.

Due to this discrepancy, the Pension Fund refused to recognise the years of study as part of the insurance record.

The situation was further complicated because the technical college that issued the diploma is located in temporarily occupied territory, making it physically impossible to obtain certificates or correct the document.

Labor Initiatives lawyers prepared a court application to establish the legal fact of document ownership.

During the proceedings, the court confirmed that the discrepancy resulted solely from translation variations and that the diploma indeed belonged to the applicant.

As a result, the court fully satisfied the claim, enabling recognition of the study period within the insurance record and proper pension recalculation.

This case demonstrates that even without access to archives in occupied territories, individuals can restore their rights through legal mechanisms.
