Lawyers from the NGO Labor Initiatives helped defend a person’s right to pension provision in court
The Pension Fund refused to grant an old-age pension because there was no record of the employer’s contribution payments. The person’s employment periods from 1 July 2000 to 1 January 2004 were not included in the insurance record.
Labor Initiatives lawyers helped prepare a claim seeking to have the Pension Fund’s refusal declared unlawful and annulled. Holding a worker responsible for an employer’s possible failure to pay contributions or submit reports violates the principle of individual responsibility and deprives the person of the state-guaranteed right to pension provision.
The court granted the claim, declared the Pension Fund’s refusal unlawful and annulled it. The court also ordered the employment periods from 1 July 2000 to 1 January 2004 to be included in the insurance record and the application for an old-age pension to be reconsidered.
