Legal Clinic Helped Serviceman Recover Compensation After Resignation

LI lawyers assisted in defending the rights of a serviceman who had been mobilized into the Ukrainian Armed Forces.

During his military service, the worker decided to resign from his civilian position, which had been preserved for him under Ukrainian law. However, after dismissal, the employer failed to calculate the final payments in full and did not compensate him for accrued vacation days.

According to the case materials, the serviceman had not taken a full vacation during the previous five years of employment.

Labour Initiatives lawyers prepared an official appeal to the employer, citing all relevant legal norms and demanding payment of the debt owed to the worker.

At the same time, LI lawyers drafted a lawsuit and deliberately submitted it to the employer for review before officially filing it in court.

After assessing the risks of liability for the principal debt, accrued interest during the delay, and legal expenses, the company’s management reconsidered its position.

As a result, during the pre-trial process, the employer recognized the claims and paid the serviceman the full amount owed – approximately UAH 90,000 (over $2,000).
