Employer’s Denial of Resignation Viewed as Violation of Labor Rights
Labor Initiatives’ legal team defended a worker whose employer consistently ignored her requests to resign and receive her final wage payments.
The employee submitted multiple resignation letters and final payment requests, yet the employer declined to process them. This action violates Article 43 of Ukraine’s Constitution, which forbids forced labor and ensures that everyone has the right to labor that he or she freely chooses or to which he or she freely agrees.
With assistance from Labor Initiatives, the employee initiated a lawsuit to end their employment and seek unpaid wages. Although the legal process was protracted, the attorneys offered ongoing guidance and handled all essential legal preparations documents.
The court recently ruled in favor of the worker, affirming that the employer violated her right to resign freely. The court ordered the employer to process the resignation and pay the outstanding wages.
